Terms of use

These Terms of Use ("the Terms") form a legally binding contract between you, as a user, and WANYIYIN, a public limited company under Beninese law whose registered office is in Cotonou, Republic of Benin.

The WANYIYIN application is a premium dating platform operating in Africa. It allows adults to create a profile, discover other verified profiles, talk through built-in messaging and use a service that arranges in-person meetings.

By downloading, installing, accessing or using the application, you acknowledge that you have read, understood and accepted these Terms in full and without reservation, together with the Privacy Policy and the particular conditions applying to your Circle. If you do not accept these Terms, you must stop using the application immediately.

Application

The WANYIYIN mobile app, available on the App Store and Google Play Store, together with any associated web version, in its current and future versions

User

Any natural person of full age who has created an account on the application and accepted these Terms

Profile

All the information, photographs and content entered by the user in their personal space

KYC verification

The manual identity check carried out by WANYIYIN's team, confirming that an official identity document is genuine

Tokens

The virtual currency used inside the application. Tokens are non-refundable, cannot be converted into legal tender and have no monetary value outside the application

Circle

The user's membership level, set by the token pack they have bought, which determines the range of features available to them

Match

The situation where two users express mutual interest, which unlocks the ability to start a conversation

Agency Service

The optional service of arranging and facilitating in-person meetings between two users already in contact

Verified badge

The mark shown on the profile of a user who has successfully completed KYC verification

Article 3.1. Eligibility. The user must meet all of the following conditions:

• Be a natural person aged at least eighteen (18) on the date of registration, without exception
• Have full legal capacity to contract under the law of their country of residence
• Live or be staying in a covered territory (Benin, Togo, Côte d'Ivoire, Senegal, or any other country expressly added by WANYIYIN)
• Have a valid, active mobile phone number in a covered territory
• Not have been suspended or permanently excluded from the application
• Act in their own name and on their own behalf, not for or on behalf of a third party

Article 3.2. Registration. Registration takes place exclusively through the application and involves the following steps:

• Entering a valid mobile phone number, which serves as the main identifier
• Verifying the number with a one-time OTP code
• Creating a confidential personal password meeting the minimum security criteria
• Completing the profile (surname, first name, date of birth, photographs, description)
• Submitting a valid official identity document for KYC verification
• Expressly accepting these Terms, the Privacy Policy and the applicable particular conditions

Article 3.3. KYC verification. WANYIYIN checks each user's identity by hand within a maximum of forty-eight (48) working hours of the document being submitted, using trained human agents. Obtaining the Verified badge is a precondition of access to the full set of features. WANYIYIN reserves the right to refuse or cancel verification where a document is illegible, suspicious, expired or non-compliant.

Article 4.1. Services offered:

• Creating and managing a verifiable personal profile
• Viewing the profiles of other verified users
• A matching system based on mutual expression of interest
• Built-in messaging between users who have matched
• A token system giving access to premium features
• The Agency Service for arranging in-person meetings, on express request and against dedicated tokens
• Personalised notifications, profile boosts and improved visibility depending on the Circle

Article 4.2. Legal nature of tokens. WANYIYIN tokens are single-use electronic value vouchers, strictly limited to the application. They do not constitute electronic money within the meaning of Directive 2009/110/EC or any equivalent regulation, cannot be refunded in cash, and may under no circumstances be exchanged, sold, transferred or assigned to third parties.

Buying tokens is firm and final. No refund is made once the tokens have been credited to the account, except where a technical fault is duly established by WANYIYIN. Tokens have no expiry date for as long as the account is active and in good standing.

Article 4.3. What each action costs:

• Sending a message to a Match: 3 tokens per message
• Boosting your profile for 24 hours: 15 tokens
• Sending a Super Like to a profile: 8 tokens
• Rewind, to see a profile you skipped or blocked again: 5 tokens

These prices may be changed subject to thirty (30) days' notice given by any appropriate means. A change does not affect tokens already acquired.

Article 4.4. Buying tokens. Tokens can be bought from the application using MTN Mobile Money, Moov Money, Visa/Mastercard bank cards and any other method integrated by WANYIYIN. Prices shown include all taxes. Every transaction produces an electronic confirmation sent by email or SMS.

Article 5.1. General standards of behaviour. The user undertakes to:

• Provide accurate, complete and up-to-date information
• Use a recent, representative photograph in which they are the only person visible
• Treat every other user with respect, dignity and kindness
• Keep their login details confidential and never share them
• Report any suspicious or inappropriate content or behaviour immediately
• Use the application for personal, non-commercial purposes only

Article 5.2. Expressly prohibited conduct, on pain of immediate suspension or termination and, where appropriate, legal proceedings:

• Creating a profile using another person's real identity or photographs (impersonation)
• Creating several accounts at the same time, or again after a suspension or exclusion
• Using the application for canvassing, advertising, soliciting or promoting third-party services
• Sending messages that are hateful, discriminatory, obscene, threatening or harassing
• Asking other users for money, transfers or any financial advantage (romance scams)
• Using bots, scripts or any automated means of accessing the application
• Attempting to bypass, alter or disable the security or verification mechanisms
• Collecting or storing other users' personal data without their express consent
• Sharing other users' information, photographs or content outside the application without their agreement
• Publishing pornographic or violent content, content glorifying crime, or content harming the rights of minors
• Falsely presenting oneself as a representative, employee or agent of WANYIYIN

Article 6.1. Access to features is organised across five (5) Circles, determined by the level of tokens bought. You move from one Circle to another by buying the corresponding pack.

Article 6.2. Agency Service. An optional premium service available from the Explore Circle upwards. A designated WANYIYIN agent helps arrange an in-person meeting between two users who have matched and exchanged messages for at least seventy-two (72) hours. One user starts the request, subject to the other's express consent. WANYIYIN acts as a facilitating intermediary and cannot be held responsible for how the meeting goes, for any incident, or for anything that follows from it.

Article 7.1. The WANYIYIN application and all of its components (source code, interface, design, database, algorithms, trade mark, logo, typefaces, proprietary photographs, text, sound) are the exclusive property of WANYIYIN S.A. and are protected in particular by Loi n°2017-20 of 20 April 2018 establishing the Digital Code of the Republic of Benin.

Article 7.2. WANYIYIN grants the user a personal, non-exclusive, non-transferable, revocable and time-limited licence to use the application, strictly for personal, non-commercial use.

Article 7.3. The user keeps the intellectual property in the content they publish. By publishing it, however, they grant WANYIYIN a worldwide, non-exclusive, royalty-free, sub-licensable and transferable licence to use, reproduce, modify, adapt, distribute and display it, for the sole purpose of operating, improving and promoting the application. They warrant that they hold all necessary rights in that content.

Article 8.1. WANYIYIN takes all reasonable steps to keep the application available and working properly, but cannot guarantee continuous, uninterrupted availability (maintenance, updates, force majeure).

So far as applicable law permits, WANYIYIN cannot be held liable for:

• Indirect, incidental, special or punitive damage arising from use of, or inability to use, the application
• The conduct, statements or behaviour of users, online or offline
• The consequences of in-person meetings arranged between users, whether through the Agency Service or independently
• Loss of data, profit, reputation or any other intangible loss

Article 8.2. The user is solely responsible for how they use the application, for the content they publish and for the interactions they start. They undertake to indemnify WANYIYIN against any claim arising from their breach of these Terms.

Article 9.1. You may delete your account at any time from the app settings ("My account" then "Delete my account"). Deleting it means permanently losing any unused tokens, with no right to a refund. Personal data is deleted within thirty (30) days, subject to legal retention obligations.

Article 9.2. WANYIYIN may suspend or terminate an account, without notice or compensation, in the following cases:

• Breach of these Terms, in particular the prohibitions in article 5.2
• Providing false or inaccurate information
• Harassing, threatening or abusive behaviour towards other users or WANYIYIN staff
• Using the application for fraudulent or commercial purposes, or purposes contrary to public order
• Repeated reports from several users
• A court decision or order from a competent authority
• Prolonged inactivity (no login for more than twelve consecutive months)

Article 9.3. Any user can report a profile or inappropriate behaviour from within the application. WANYIYIN undertakes to review every report within seventy-two (72) working hours.

The Specific Terms and Conditions ("STC") supplement and clarify these Terms. Where the two conflict, the STC prevail on the matters they specifically govern.

Nature of the Circles: Circles are not recurring monthly or annual subscriptions but one-off credit purchases. No automatic renewal is set up without the user's express agreement.

Launch bonus: during the ninety days following the official launch (from 11 September to 11 December 2026 inclusive), bonus tokens are added to each pack purchase, once per user and per Circle:

• Starter Circle, 2,000 FCFA: 60 tokens bought + 20 bonus tokens = 80 tokens
• Explore Circle, 5,000 FCFA: 180 tokens bought + 50 bonus tokens = 230 tokens
• Premium Circle, 10,000 FCFA: 450 tokens bought + 100 bonus tokens = 550 tokens
• Elite Circle, 20,000 FCFA: 1,100 tokens bought + 200 bonus tokens = 1,300 tokens

Elite Circle features:

• Absolute priority in the suggestions feed, placed among the first three profiles shown
• Elite badge visible on the profile
• Priority access to the Agency Service, with no waiting time
• Dedicated customer support with a guaranteed reply within 24 working hours
• Early access to new features
• Priority invitations to every WANYIYIN event

Rules for publishing photographs:

• The main photo must clearly show the user's face and no one else's, without distorting filters
• Every photograph must show the user themselves and no one else
• Sexually explicit, nude or suggestive photographs are strictly forbidden
• Photographs showing minors are strictly forbidden

Diaspora: the application can be downloaded and used from abroad. Location-based matching and the Agency Service, however, remain available only in the covered countries.

Algorithm: the composite scoring formula, the cultural compatibility matrices, the trained models and the user vectors are trade secrets. No reverse engineering, decompilation or attempted extraction is permitted.

Article 10.1. Changes to the Terms. WANYIYIN reserves the right to change these Terms at any time. Where a change is substantial, the user is informed by push notification and/or email at least thirty (30) days before it takes effect. Using the application after that date counts as acceptance.

Article 10.2. Governing law and jurisdiction. These Terms are governed by Beninese law. In the event of a dispute, the parties undertake to seek an amicable solution within thirty (30) days. Failing that, any dispute will be submitted to the exclusive jurisdiction of the courts of Cotonou, Republic of Benin.

Article 10.3. Partial invalidity. If any provision is declared void, unlawful or unenforceable, the others remain in force and the void provision is replaced by a valid one coming as close as possible to the parties' intention.
